Freedom & creativity: defending art, defending diversity, special edition

To honour their commitment under international treaties, States are encouraged to incorporate artistic freedom in their national laws and to adopt specific policies and orientations. Interventions and new developments can occur at different levels: executive, legislative and judiciary. There remains room for improvement in all three areas and despite some progress, legislation has continued to be more of a tool to limit artistic freedom than a tool for its promotion and protection. In different contexts, governments and public authorities continue to use their power to curtail artistic expressions instead of creating the conditions for debates on the issues that prompt their intervention.
